Supplier conditions

On accepting a shipment from us, all suppliers are deemed to have accepted the following supplier conditions.

(1)  Further sub-contracting of any shipment is forbidden unless we have been informed and agreed to this before the load has been collected.

(2)   If you are a sub-contractor who does sub-contract, you must ensure that your sub-contractors have adequate insurance and you have a procedure in place to assure proper and timely review of all your subcontractor’s insurance. You will be fully responsible in the event of your subcontractor not being adequately insured.

(3)   Even when sub-contracting is allowed, further sub-contracting is not.

(4)   Notwithstanding Articles 37-39 of CMR, you as a sub-contractor of Espace Europe Ltd shall be fully liable to indemnify us in respect of any claims and in particular to be fully responsible for the actions of their sub-contractors as if their own actions.

(5)   Responsibility will remain with you as our subcontractor even if your second sub-contractor in turn sub-contracts.

( 6) In accepting a shipment, you hereby agree that if you subcontract this load then you agree to accept liability as the first carrier.

(7) The above points relate not only to sub-contracting of the whole movement, but any part thereof.
